This CLE will explore procedural pitfalls and tactical issues that attorneys commonly face when they bring professional malpractice claims in Minnesota.  A particular focus will be the affidavits of expert review required by Minn. Stat. sec. 544.42, subd. 2, including (a) whether the “mandatory dismissal” for untimeliness is really “mandatory,” (b) what is required for the affidavits to be sufficient on a substantive basis, and (c) whether an affidavit is always required.  Pleading and settlement issues involving insurance coverage also will be discussed.
